WHAT DO WE DO WITH YOUR INFORMATION?

When you purchase something from our store, as part of the buying and selling process, we collect the personal information you give us such as your name, address and email address.

When you browse our store, we also automatically receive your computer’s internet protocol (IP) address in order to provide us with information that helps us learn about your browser and operating system.

Email marketing (if applicable): With your permission, we may send you emails about our store, new products and other updates.

SHOPIFY

Our store is hosted on Shopify Inc. They provide us with the online e-commerce platform that allows us to sell our products and services to you.

Your data is stored through Shopify’s data storage, databases and the general Shopify application. They store your data on a secure server behind a firewall.

Payment:

If you choose a direct payment gateway to complete your purchase, then Shopify stores your credit card data. It is encrypted through the Payment Card Industry Data Security Standard (PCI-DSS). Your purchase transaction data is stored only as long as is necessary to complete your purchase transaction. After that is complete, your purchase transaction information is deleted.

All direct payment gateways adhere to the standards set by PCI-DSS as managed by the PCI Security Standards Council, which is a joint effort of brands like Visa, Mastercard, American Express and Discover.

PCI-DSS requirements help ensure the secure handling of credit card information by our store and its service providers.

THIRD-PARTY SERVICES

1. Objective and Responsible Authority: These privacy policies clarify the extent and purpose of the processing (i.e. survey the processing and use of collected information as well as obtaining permission) of personal data within our online content as well as with related websites, functions and contents (hereafter referred to as “online content” or “website”). The privacy policy applies independently from used domains, systems, platforms and devices (e.g. desktop or mobile) on which the online content is accessed. The content provider and the party responsible for the data protection is HERMETIC COFFEE ROASTERS, Mika Neu (CEO), Oeverseestr 10-12, 22769 Hamburg, Germany (hereafter referred to as “provider”, “we”, or “us”). For contact information, refer to our Homepage (Impressum). The term “user” includes all customers and visitors to our website. The terms used for e.g. “user” are unisex for simplification.
2. Basic information on Data Processing: We process personal data from the user only under compliance to the relevant data protection regulations referring to the rules of  data economy and data avoidance. This means the user’s data is only available with legal permission, in particular when the data is necessary for the supply of contractual benefits or when legally required or by form of consent. We combine organized, contractual, and technical aspects to achieve state of the art security measures, to ensure that the requirements of the data protection laws are met and with them, that the processed data is protected against random or deliberate manipulation, loss, destruction, or access by unauthorized persons. If within the contents of this privacy policy, tools, or other means from other providers, (subsequently referred to as “Third Parties”) that are based overseas, are used, it is to be expected that a data transfer would take place in the home branch of said Third Party. The transfer of data in third places would occur on the base of either legal permission, with consent of the user or special contractual clauses, with a legally provided data security guarantee.
3. Processing of Personal Data: Personal data will, on the base of legal permission or consent of the user, besides the expressly named uses in this privacy policy, be used for the following purposes: the provision, execution, care as well as the optimization and protection of our online content, services, and user-service, along with the guarantee of effective customer service and technical support. We share the user’s data with Third Parties only when necessary for billing purposes, or in order to fulfill our contractual obligations to the user (e.g. providing addresses to suppliers). By contacting us (by form or by email), the user’s details will, for the purpose of revision in the occurrence of follow up questions, be saved.  Personal data will be deleted once the intended purpose has been completed and there are no opposing retention requirements for the data.
4. Survey of Access Data: We collect data over every visit to our Server, on which these services are found (in so named Service Log Files). The Survey Data is made up of the requested website, file, date and time of access, the amount of data transferred, notification of a successful processing request, browser type including version, the operating system of the user, the referral URL (the website previously visited), the IP- Address, and the operating Provider. We use the log files with connection to individual users or other profiling, in accordance with legal requirements, only for statistical evaluation for the purposes of the business operation, as well as the security and optimization of our online content. We do however, reserve the right to retrospectively review the log files on the basis of retrieving specific evidence when there is justified suspicion of illegal activity or use.
5. Cookies and Range of Coverage: Cookies are information, that are transmitted from our Web Server or Third Party Servers to the user’s web browser, and saved for retrieval. Within the framework of this data privacy statement, users are informed about the use of cookies for pseudonymous online reach measurements.  The analysis of the online content is also possible under exclusion from cookies. In the case that users do not want cookies saved on their device, it is possible to deactivate them in the browser settings. Previously saved cookies can be found in the browser settings and deleted. The exclusion of cookies can lead to limited function on the website. 6. Google Analytics: We use Google Analytics, a Web analysis service from Google Inc. (“Google”). Google utilizes Cookies. The information that is generated through the Cookie through the user’s use of the website or online content is most often transmitted and saved by a Google server in the USA. Google uses the information around the use of our website through user evaluation, reports put together of the activity within the website and from further uses of the website, as well as the associated services of web usage to form the analytics to bring us forward. As a result  of the processed data, pseudonym user profiles of the user are developed. We activate the settings of Google Analytics to anonymise the IP-Addresses. This means that the IP-Address of the user is, when within the countries belonging to the European Union or in other states in agreement within the European Economic Area, shortened by Google. Only in certain exceptions would a Google Server in the USA transmit the full IP-Address and shorten it in there. The IP-Addresses transmitted from the User’s Browser would not be merged with other data from Google. The User can prevent Cookies from being saved through an appropriate setting on the Browser-Software; the User can, besides that, impede the logging produced through Cookies and the release of data to Google through use of the website, as well as the processing of said data through Google by loading and installing the link below to the available Browser-Plugin: http://tools.google.com/dlpage/gaoptout?hl=de. 7. Google - Re/Marketing - Services: We use the marketing and remarketing services (short “Google-Marketing-Services) offered by Google Inc, 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA (“Google”). The Google-Marketing-Services allows us to display aimed advertisements for and on our website, to only present users with advertisements centered around them, that potentially correspond with their interests. In the case that, for example, advertisements of products are displayed to the user from other websites of interest, this is what would be referred to as “remarketing”. To these purposes, a code is executed directly through Google and it will be drawn into in the website by so called (Re)marketing-Tags (iinvisible graphics or code, also referred to as “Web Beacons”) that are integrated in the website. These tags will be activated by access to our and other websites that use Google-Marketing-Services. With their help, an individual Cookie, that means a small file (comparable technology can be used in place of cookies), will be saved on the User’s device. Cookies can be send from different domains, among others from google.com, doubleclick.net, invitemedia.com, admeld.com, googlesyndication.com or googleadservices.com. Noted in this file, are which websites the user has visited, what contents the user is interested in and which offers the user clicked on, in addition, technical information from the browser and the operating system, referring websites, visiting times as well as more details regarding the use of online content. The IP-Address of the user will also be collected, whereby we, within the framework of Google-Analytics, communicate that the IP-Address from within the member states of the European Union or in other states in agreement with the European Economic Area will be shortened and only in exceptional cases transferred fully to a Google Server in the USA and there shortened.  The IP-Address will not match with the user’s data from other offers within Google. This prominently stated information can be, along with other such information, found through other sources. When the user subsequently visits other websites, appropriate advertisements can be displayed that are coordinated with the user’s interests. The user’s data will be, in the framework of Google-Marketing-Services, pseudonymously processed. This mean that Google saves and processes for example, not the name or email address of the user, but rather the relevant data obtained by Cookies, all within pseudonymous user profiles. That means that from of the viewpoint of Google, the advertisements are not displayed or managed for a specifically identified person, but rather, for the Cookie-Holder, entirely independent from whoever the Cookie-Holder is. This is not valid when a user has expressed authorisation to Google, to process the data without this pseudonymisation. The information collected about the user from “DoubleClick” will be transmitted to Google and saved on Google Servers in the USA. The online advertising program from Google-Marketing-Services that is used by us belongs under others to “Google AdWords”. In the case of Google AdWords, another “Conversion-Cookie” is available to every AdWords customer. Cookies can therefore not be traced over the websites from AdWords customers. With the help of Cookies, collected information is used to develop conversion statistics for AdWord clients, that have decided to use conversion tracking. The AdWords clients will learn the total number of users that have clicked on the display, and accidental sites will be forwarded with a conversion tracking tag. They do however, not keep any information with which the user can be personally identified. On the basis of Google-Marketing-Services “DoubleClick”, we integrate Third Party advertising. DoubleClick processes Cookies, with which Google and their partner websites, on the basis of the visit by the user, insert advertisements, respectively enabling other websites on the internet. We also integrate “AdSense”, third party advertisements, on the basis of Google-Marketing-Services. AdSense processes Cookies, with which Google and their partner websites, on the basis of the visit by the user, insert advertisements, respectively facilitating other websites on the internet. Another service we use from Google-Marketing-Service is the “Google Tag Manager”. With its help, we can integrate Google Analytics and Marketing Services further into our website (eg. “AdWords”, “DoubleClick” or “Google Analytics”). 8. Facebook Social Plugins: Our online content uses Social Plugins (“Plugins”) of the social network facebook.com, run by Facebook Ireland Ltd., 4 Grand Canal Square, Grand Canal Harbour, Dublin 2, Ireland (“Facebook”). The plugins are clearly identifiable Facebook Logos (white “f” on a blue square, the recognisable “Like” or a “Thumbs Up”- sign) or are labelled as a “Facebook Social Plugin”. The list and appearance of the Facebook Social Plugins can be seen here: https://developers.facebook.com/docs/plugins/.  When a user activates a function of the website that contains such a plugin, it forms a direct link with the server from Facebook on the user’s device. The content of the plugins will be directly transmitted, from Facebook, on the user’s device and integrated into the website by them. This means that we have no influence over the extent of data which Facebook obtains with the help of these plugins and therefore, inform the user according to our state of knowledge. Facebook receives the information that a user has viewed a corresponding site of the online content through the integration of plugins. If the user is logged into their account, Facebook can match the website visit to said account. When the user interacts with plugins, operating the “Like Button” for example, or by submitting a comment, the correlating information will be directly transmitted, from the user’s device, on Facebook and saved there. In the case that a user is not a Facebook member, the possibility nevertheless exists, that Facebook learns and saves the user’s IP-Address. According to Facebook, the IP-Address is saved anonymously. When a user is a Facebook member and does not want that Facebook collects personal data over the website, saving and linking it to the user’s account, the user must then logout of Facebook before using our online content and delete the related cookies. 9. Facebook Remarketing: Within our online content so called “Facebook-Pixels” of the social network Facebook, Facebook Inc., 1 Hacker Way, Menlo Park, CA 94025, USA or in the case the user is a EU resident, Facebook Ireland Ltd., 4 Grand Canal Square, Grand Canal Harbour, Dublin 2, Ireland, are inserted. With the help of Facebook-Pixels, it is possible that visitors to our online content can agree to our so called “Facebook ads” as target groups for our advertisements. We set the Facebook-Pixels appropriately, so that Facebook ads are displayed only to Facebook users that have an interest in our online content. That means, with the help of Facebook-Pixels, that we want to ensure that our Facebook ads are appropriate to the potential interest of the user and not an inconvenience or annoyance. Facebook-Pixels enable us to further the effectiveness of Facebook advertisements for statistical and marketing investigation purposes and for a better understanding. By them, we see whether the user, after clicking on a Facebook advertisement, is connected to our website. Facebook-Pixels are invoked on our website as a direct result through integrating Facebook and causes so called Cookies (small files) to be stored on the user’s device. When a user visits our website while logged into Facebook or subsequently does so, the visit will be recorded to the user’s profile. The data collected about the user is anonymous, which offers us no conclusions as to the identity of the user. However, the data from Facebook will be saved and processed, so that a connection to respective user profiles is possible. The processing of the data through Facebook takes place within the framework of Facebook’s use of data policy. Further appropriate information regarding the working function of Remarketing-Pixels and a general description of Facebook-Ads, can be obtained through Facebook’s data use of data policy:  https://www.facebook.com/policy.php. The user can review the collection and use of personal data through the use of Facebook-Pixels through the outline of Facebook-Ads. The settings are platform independent which means that they will be accepted by all devices, eg. desktop or mobile device.
10. Piwik-Statistics: We use Piwik, an open source software that statistically analyses user access. Piwik processes the Cookies that will be saved on the user’s computer and enables an analysis of the use of the online content through the user. From the processed data, pseudonymous user profiles of the user can be created. They, through the cookie, will generate information over the use of these offers and save them within our server. The IP-Address will be, directly after processing and before being saved, made anonymous.
11. etracker: We use the analysis service “etracker”, the etracker GmbH, Erste Brunnenstraße 1 20459 Hamburg. Pseudonym user profiles of users can be created from the data processed through etracker. Cookies can be used as well. The cookies enable the service to recognize the user’s browser. The data collected through etracker technology will not be used to identify the visitor and will not be combined with personal data about the bearer of the pseudonym without separately issued consent of the respective individual. At any time in the future, the user can object to the collection and saving of data. At the point the user chooses to object, the user can follow the subsequent link to obtain an Opt-Out-Cookie from etracker which causes future visitor data not to be collected or saved by etracker, an Opt-Out-Cookie with the name “cntcookie” will be placed by etracker. The user should not delete this cookie in order to maintain this objection to the collection and saving of personal data. 12. Twitter - Links: We use function buttons from the service, Twitter. These function buttons are provided through Twitter Inc., 795 Folsom St., Suite 600, San Francisco, CA 94107, USA. They are generally identified by the term “Twitter” or “follow” or recognised by the stylized blue bird. By using these function buttons, it is possible to post or share about the website or online offers on Twitter or to follow the promoters on Twitter. When a user of a website that uses these online offers, where such a function button is available, it builds a direct connection from the server to Twitter. The contents of such Twitter links is transmitted directly from Twitter to the user’s browser. Therefore, we have no influence on the extent of the data which Twitter, with the help of these plugins, gathers and we inform the user in accordance to our state of knowledge. After this, only the IP-Address of the user’s URL of the respective website will be collected by the link and transferred, but it is not used for purposes other than making the link available. 13. Pinterest - Links: We use the function button (“Pin it”) from the service Pinterest, http://pinterest.com/. WIth the help of the function buttons, it is possible for the user to share our articles or website on said user’s “Pinterest-Board”. When a user accesses a website that contains a “Pin It” button, it builds a direct link to the server Pinterest holds. The content of the “Pin It” button will be directly transmitted from Pinterest to the user’s browser. We have, therefore, no influence over the amount of data that Pinterest collects with the help of these “Pin It” buttons, and we inform the user in accordance with our state of knowledge. After this, only the IP-Address of the user’s URL of the respective website will be collected by the link and transferred, but it is not used for purposes other than to display the “Pin It” buttons which makes it possible to share the contents of the website. 14. Google +: We use the function buttons of the social network, Google+ (e.g. “+1” - button), which is operated by Google Inc., 1600 Amphitheatre Parkway, Mountain View, CA 94043, United States (“Google”). When a user accesses a website containing this online offer, the contents of the function button are transmitted directly to the user’s browser from Google and integrated into the website. Therefore, the provider has no influence over the amount of data that Google collects through the function buttons. According to Google, no personal data will be collected without clicking on the function button. Such data will however, only be collected and processed, under another IP-Address, by logged in Google+ members. 15. Newsletter: With the following information, the contents of our Newsletter as well as registration and subscription to, the sending of, and the statistical evaluation procedure, along with the user’s right of objection, will be explained. By subscribing to our newsletter, the user consents to receiving the newsletter and agrees with the described procedure. Newsletter Contents: We send newsletters, emails, as well as further electronic notices with promotional information (subsequently referred to as “newsletter”)  only with consent from the recipient or with other legal allowance. The implications of a subscription to our newsletter, the contents of which will be described in detail, are relevant for the user to know in order to give such permission. Also included in our newsletter is the following information: our products, offers, promotions and news from our company. Double-Opt-In- and Logging: Registration to our newsletter occurs in a so called “Double-Opt-In” procedure. This means that after registering, the user will receive an email confirming the registration request. This confirmation is necessary, so that no one can sign on without a verified email address. In order to prove that the registration process is in accordance with legal requirements, the registration to the newsletter will be recorded. The act of saving registration data, such as the date of written confirmation, as well as the IP-Address, pertains to this purpose. The amendments made by the user will be recorded by the service provider. Service Provider: the newsletter is delivered from Mailchimp by The Rocket Science Group, LLC, 675 Ponce de Leon Ave NE, Suite 5000, Atlanta, GA 30308 USA (subsequently referred to as “service provider”). The data protection regulations of the Service Providers can be seen here https://mailchimp.com/legal/data-processing-addendum/ The email addresses of the recipients of our newsletter, as well as the described data within the scope of this notice, will also be saved on the server of the service provider. The service provider uses this information in order to dispatch and analyse the newsletter in our order. Furthermore, this allows the service provider, using our own information, to optimize the data or improve the use of our services. For example, optimizing the technical aspects of the service, the presentation of the newsletter or using the information for other commercial purposes. It can also be used to determine which country the recipient comes from. However, the service provider does not use the data of the newsletter recipients in order to write them directly or to share the information with third parties. Registered Data: in order to subscribe to the newsletter, supplying an email address will suffice. Another option is to supply us with the following data: first name and surname to personalize the newsletter. Date of birth, gender and industry to personalize the content of the newsletter to the interests of our readers. Statistical Evaluation and Analysis - The newsletter contains a so called “web-beacon”, a pixel sized file, which will be retrieved by opening the newsletter from the server of the service provider. Within the framework of these requests, certain technical information is collected, including information regarding the browser and the user’s system, as well as the user’s IP-Address and the time of access. This information will be used for the technical improvement of services with the the aid of the technical data or target groups and the users’ reading behaviours, along with the place of access (which are determined with the help of the IP-Address) or the access times. The assessment of whether the newsletter is opened or not, and if so, when it is opened, as well as which links are clicked, belong to the statistical survey as well. This information can, from technical grounds, be associated with individual newsletter recipients. It is however, not our intention as service providers, to observe individual users. The evaluation serves us better in the purpose of identifying the reading habits of our users and to adapt our content to the user or to send different content in accordance with the interest of the user. Termination/Cancellation: The user can terminate a subscription to our newsletter at any time, in other terms, to revoke such permission previously given. With that action, the user’s consent in subscribing to the service provider and the statistical analysis will be deleted at the same time. A separate cancellation of subscription to the service provider or the statistical evaluation is unfortunately, not possible. Involvement of Service Providers and Third Parties: It can occur that content or services from Third Parties, like for example, city plans or typefaces from other websites, are integrated into our online offers. The integration of content from Third Parties is always set clearly, so that the Third Service’s use of the IP-Address of the user can be recognised in the context that without the IP-Address, the content cannot be sent to the browser. The IP-Address is necessary in order to display such content. Furthermore, the provider of the third content can set their own cookies and process the user’s data for their own purposes. Thereby, allowing them to create user profiles from the processed data of the user. We prefer to set these contents avoiding and preventing data use in regard to data security in choosing reliable Third Providers. The subsequent statement provides and contains an overview from Third Providers, as well as their content, in addition to links to their privacy policies, and other further notices regarding processing of data, already partially named here, objection options (so called Opt-Out):

16. Rights of the User and Deletion of Data: Users have the right to request to receive free information regarding the personal data that we will save about them. Users have the additional right to amend false data, to revoke permission given, to block and delete personal data as well as to the right, in the case of acceptance of the unlawful processing of data, to submit a complaint by the responsible supervisory authorities. The data previously saved by us will be deleted, as soon as it has served its intended purpose as it is still necessary to complete services for the user, and the deletion opposes no legal retention requirements.
17.  Amendments to the Privacy Policy: We retain the right to amend the privacy policy in the case of a changed legal situation, changes to the services provided, as well as adaptations to the processing of data. Though however, this applies only in regards to statements referring to data processing. Provided that permission from the user is necessary, or constitutes a part of privacy policy regulations of contractual agreements with the user, all such amendments will be made only with consent of the user. Users are requested to regularly inform themselves in order to keep up to date with the content of the privacy policy.
